SOUTHERN UTAH BASS ANGLERS INSURANCE RELEASE

PLEASE READ BEFORE SIGNING

LIABILITY INSURANCE VERIFICATION: I state that I maintain current liability insurance coverage on the boat that I will use in this tournament and throughout this calendar year in tournaments sponsored by SOUTHERN UTAH BASS ANGLERS.

ASSUMPTION OF RISK: Participants acknowledge and understands that the fishing activities involve the risk of bodily injury, death, or property damage as a result of, but not limited to participating in fishing activities during bad weather, extremely rough water and/or poor visibility hours, colliding with or striking persons, boats or other objects floating, submerged or partially submerged in the water, operating a boat without a rigid cord to kill the switch. Participants hereby assume full responsibility for any and all risk of bodily injury, death, or property damage directly or indirectly due to the negligence of SOUTHERN UTAH BASS ANGLERS or otherwise while in or about the area of the fishing activities and while participating in such fishing activities.

NO REPRESENTATION OR WARRANTIES: It is expressly agreed by participants that no representations, statements or warranties, expressed or implied, have been made by or on behalf of SOUTHERN UTAH BASS ANGLERS with respect to the fishing activities or the safety thereof.

RELEASE: Participants do herby release, acquit and discharge SOUTHERN UTAH BASS ANGLERS and from any and all rights of action, claims, demands and liabilities whatsoever, and any and all injury or damage suffered in mind, body or estate, including death, know and unknown, accrued and contingent, which participants has or may have against SOUTHERN UTAH BASS ANGLERS, arising out of any act or thing done, or omitted to be done, whether caused by the negligence or otherwise of SOUTHERN UTAH BASS ANGLERS, up to the date of this instrument and which may accrue at any time in the future by reason of participation of participants in the fishing activities.

INDEMNIFCATION: Participants shall at all times indemnify, protect, defend and hold harmless SOUTHERN UTAH BASS ANGLERS against and from all liability, loss, cost, damage, or expense sustained by SOUTHERN UTAH BASS ANGLERS:

A. Arising out of, or directly or indirectly due to, and failure of participant in any respect promptly and faithfully to satisfy its obligations under the registration form and related documents.

B. Arising out of, or directly or indirectly due to, any accident or other occurrence causing injury to any person or property resulting from the participation by participant in the fishing activities, and/or

C. For which SOUTHERN UTAH BASS ANGLERS hereafter become liable, and especially, but not exclusively, and such liability, loss, cost, damage or expense that may arise under any statues, ordinance regulation, order or other law

FIRST AID: Participants further release SOUTHERN UTAH BAS ANGLERS from any and all rights of action, claims, demands and liabilities whatsoever on account of first aid, treatment or service rendered to participants during his or her participation in the fishing activities.

SERERABILITY: Any provision of this agreement which is prohibited or unenforceable in any jurisdiction shall, as to such jurisdiction be ineffective to the extent of such prohibition of enforceability without invalidating the remaining provisions hereof, and such. To the extent permitted by applicable law, the parties hereby waive any provision of law, which renders any provision hereof prohibited or unenforceable in any respect.

CAREFUL REVIEW: The undersigned have read this agreement and understand all of its terms and execute it voluntarily and with full knowledge of its significance.
